The Mental Health Tribunal for Scotland has produced a booklet designed for service users of the Tribunal. The service users booklet can be accessed here

Named Person:

When the Mental Health Act came into effect on 5th Oct 2005, it gave individuals new rights which previously did not exist. If it is necessary for you to be treated under the new Act, the Act says that you can have a named person who will have to be informed and consulted about aspects of your care. They can also make certain applications under the Act and protect your interests if you have to be given care or treatment under the new Act.

What the Act says: 

The Act says;

  • what safeguards there are to make sure your rights are protected
  • when you can be given treatment against your will
  • when you can be taken into hospital against your will
