Curators ad litem

MHTS List of Curators ad litem

The new scheme for MHTS curators came into effect on 1 March 2021.  Existing MHTS curators who completed the new application process transferred successfully to the new scheme.  A few new curators have also been added to the List.

The "Terms and Conditions" below outline the necessary qualifications for appointment to the MHTS List of Curators ad litem.

Click on the link below to access the Terms and Conditions, which incorporate the revised Guidance for Curators ad litem (which is also available as a separate document below):

  • Terms and Conditions for MHTS Curators ad litem - Revised June 2024
  • Guidance to Curators ad litem  - Revised June 2024
  • Scale of Fees for Curators - NEW 29 April 2023
  • Curator Process / Invoice Template - NEW December 2023
  • Fees for Medical Reports by Expert Witnesses

Recruitment

The Tribunal regularly recruits legally qualified individuals to serve as curator ad litem.
At present we are particularly interested in potential curators ad litem based in the Highlands or Grampian areas.
We would also welcome applications from people with an ethnic minority background, located anywhere in Scotland.
If this is of interest to you, more information can be obtained by contacting Jenna Swan at jswan@scotcourtstribunals.gov.uk
Please note that a history of practicing in mental health law is not necessary, although familiarity with the Mental Health (Care and Treatment) (Scotland) Act 2003 is expected.  The Tribunal is looking for people who are interested in serving the needs of those who cannot represent themselves.
Legal members of the Tribunal are excluded from being a curator ad litem.
